By using the PocketCM™ mobile application, users agree to these Terms & Conditions.
Description of Service
• PocketCM™ provides automated documentation tools for behavioral health specialists, compliant with applicable laws including HIPAA.
User Registration and Account Integrity
• Users must provide accurate information and maintain the security of their account, adhering to HIPAA regulations for Protected Health Information (PHI).
Compliance with Laws
• PocketCM™ adheres to applicable laws and regulations, including HIPAA, in the handling of PHI and other user data.
Privacy and Data Use
• User data, including PHI, is managed as per the PocketCM™ Privacy Policy, in line with HIPAA and other privacy laws.
User Responsibilities
• Users agree to comply with all applicable laws in their use of PocketCM™, including the responsible handling of PHI.
Intellectual Property Rights
• All content within PocketCM™ is owned by PocketCM™ and protected by intellectual property laws.
Prohibited Use
• Users must not engage in prohibited activities such as unauthorized access, data theft, or other forms of misuse.
Limitation of Liability
• PocketCM™ is not liable for indirect, incidental, or punitive damages arising from the use of PocketCM™.
Indemnification
• Users agree to indemnify PocketCM™ against claims arising from their use of the app, including HIPAA violations.
Modifications to Terms
• PocketCM™ reserves the right to modify these Terms, with notice to users.
Dispute Resolution
• Disputes arising under these Terms will be resolved through arbitration in Dallas County, TX.
Severability
• If any part of these Terms is held to be invalid or unenforceable, the remaining parts will continue in effect.
